These General Terms and Conditions of Sale are entered into between, on the one hand, EgoFilm, a single-member simplified joint-stock company (SASU) with a capital of €1,000, registered with the Marseille Trade and Companies Register under number 937 647 840, whose registered office is located at 96 Rue Paradis, 13006 Marseille, France, publisher of the website egofilm-universe.com (hereinafter referred to as "EgoFilm"), and on the other hand, any consumer, natural person visiting or making a purchase via the said site egofilm-universe.com, hereinafter referred to as "the Customer." Any purchase on the site egofilm-universe.com (hereinafter the "Site") automatically entails the acceptance of the entirety of these conditions.

ARTICLE 1 – DEFINITIONS

Customer: refers to any user who purchases a Product through the Site and/or who has a personal account on the Site.
Order: refers to the process by which the Customer selects the Products they wish to purchase and have delivered.
An Order is finalized when the Customer has selected the Products they wish to be delivered, chosen the delivery options, and paid the required amount.
Once the Order is finalized, EgoFilm will handle the processing of your Order. This includes the production of personalized products, as well as their shipment, in collaboration with our production and logistics partners located in France and abroad. Depending on the Customer’s delivery address, EgoFilm may use different partners to ensure the manufacture and delivery of the Products (for instance, a European partner for non-US deliveries, and a US-based partner for deliveries within the United States).
Contract: refers to these General Terms and Conditions of Sale and any specific conditions applicable to certain promotional operations. Consequently, the Customer waives the right to invoke any contradictory document that would oppose the Contract and would therefore be unenforceable against EgoFilm.
Personal Data: refers to all personal information relating to the Customer, a natural person, provided by them during the Order.
Parties: collectively refers to EgoFilm and the Site Users.
Products: refers to the products available for sale on the Site.
User: refers to any natural or legal person accessing the Site, whether or not they are a Customer.

ARTICLE 2 – PURPOSE OF THE TERMS AND CONDITIONS AND THE APPLICABLE VERSION

2.1. These General Terms and Conditions aim to define the terms under which Users can access the Site, place Orders, and manage the relationships between EgoFilm and Users, including all the rights and obligations arising therefrom.
2.2. These Terms and Conditions govern the relationships between Users and EgoFilm, as well as between Users themselves. Each User agrees to comply, without restriction or reservation, with these Terms and Conditions, whether visiting the Site or placing an Order. The Terms and Conditions are notified to Users for acceptance prior to any Order on the Site.
2.3. EgoFilm is free to modify these Terms and Conditions at any time and without notice, particularly to reflect any legal, case law, and/or technical changes. EgoFilm will inform the User by any means, and the User must accept the new Terms and Conditions.
In any case, the User’s continued use of the Site after being informed of the modification of the Terms and Conditions constitutes acceptance of such modifications by the User.
Successive versions of the Terms and Conditions will be accessible from the Site.
2.4. The prevailing version of the Terms and Conditions is the latest available version on the Site.
2.5. The version applicable to an Order is the one in force on the date the Order is placed.
Each new Order requires acceptance of the Terms and Conditions by the Customer, which the Customer acknowledges and accepts.
If Users do not accept the Terms and Conditions or their subsequent modifications, they must cease any use of the Site.
2.6. The User declares having obtained from EgoFilm, prior to placing an order, all the information regarding the Products and delivery methods. They declare being solely responsible for the choice of Products and their suitability for their needs.
2.7. The User must be either a duly represented legal entity or a legally capable adult natural person to place an Order on the Site. Otherwise, they must have authorization from their legal representative to place an Order, which they expressly acknowledge and accept.
2.8. Some illustrations or designs offered on the Site may contain humorous, satirical elements or content intended for a mature audience. These creations, although compliant with good morals and current legislation, might not be suitable for the sensitivity of young children. It is the responsibility of parents or legal guardians to ensure the appropriateness of the content with the educational values they wish to convey. EgoFilm disclaims any liability for any inappropriate interpretation of these creations.

Some sections of the Site include products designed for children (for example, T-shirts from the Kids section). Parents or legal guardians are responsible for purchases made by minors and for supervising their use of the Site and its content.

ARTICLE 3 – PRICE

All prices shown on the Site are indicated in euros, including all French taxes (French VAT and any other applicable taxes), excluding shipping costs.
Shipping costs are calculated and displayed in the Customer’s cart before the final validation of the order.
To facilitate international purchases, prices are automatically converted and displayed in the Customer’s local currency. However, transactions are made in the currency indicated at the time of the order, and the applied conversion rate may vary depending on financial market fluctuations.

Shipping rates and applicable taxes may differ depending on the Customer’s delivery zone (United States or other countries). The final price, including shipping, is always displayed before payment confirmation.
EgoFilm reserves the right to modify its prices without notice. The prices applied to the Customer correspond to those displayed on the Site at the time of the order.

ARTICLE 4 – PRESENTATION OF ITEMS

The User is informed that photographs of the Products are available on the Site, which they can freely consult.
EgoFilm strives to ensure that the photographs of the Products are as faithful as possible to the Products actually delivered to the Customer (in particular regarding color). Nevertheless, EgoFilm cannot guarantee that the Products will be exactly identical to the photographs, particularly due to technical constraints related to making the photographs available on the Site.
Furthermore, EgoFilm endeavors to present and describe its Products as accurately as possible.
Elements such as photographs, texts, graphics as well as all information and characteristics illustrating and/or accompanying the Products are not contractual, which the Customer acknowledges.
The User who wishes to receive additional information about a Product is invited to contact the Customer Service at the following address: support@egofilm-universe.com
This does not affect the Customer’s legal warranty rights for non-conformity or hidden defects, as provided for in Articles L217-4 and following of the French Consumer Code.
The User declares having full knowledge of the provisions of this article and already expressly agrees not to hold EgoFilm liable in this respect, subject to the application of mandatory legal provisions (such as the conformity guarantee).

ARTICLE 4.1 – CUSTOMIZED VIDEO SERVICES (DIGITAL PERSONALIZED PRODUCTS)

1. Purpose of the Service The Seller offers a personalized digital 3D video at a fixed price of €24.99 (incl. VAT). At the time of order, the Client must select the following options:

• Audience: Adult or Child.
• Language: French or English.
• Personalization: The first name provided by the Client.

1. Content Moderation The Client agrees not to provide first names or messages that are offensive, hateful, discriminatory, or contrary to public order. EgoFilm reserves the right to cancel and fully refund any order that does not comply with these ethical standards.
2. No Right of Withdrawal In accordance with Article L221-28, 3° of the French Consumer Code, as the video is customized according to the Client’s specific instructions, the Client expressly waives their right of withdrawal upon validation of the order. No refunds are possible after payment.
3. Production and Delivery Time The video is produced and sent to the Client within 24 to 48 hours following payment confirmation. It is delivered via email through a secure Google Drive download link. No shipping fees apply.
4. File Access and Retention The download link remains active for 30 days. It is the Client’s responsibility to download and save the video locally within this period. EgoFilm will permanently delete the file after 30 days and shall have no obligation to resend it.
5. Client Responsibility The Seller cannot be held liable for incorrect email addresses, delivery emails blocked by SPAM filters, or failure to download the file within the 30-day timeframe.

ARTICLE 5 – ORDER

The User can browse the Site without being obligated to make a purchase.
To place an Order, the Customer selects the Products of their choice on the Site and adds them to their virtual cart.
Creating a personal account on the Site is not necessary to place an Order.
However, some personal data of the Customer is required for the proper execution of the Order by EgoFilm.
If the Customer wishes, they have the option of creating a personal account allowing them, in particular, to track their Order history on the Site and retrieve the corresponding confirmations and invoices. Some personal data of the Customer are required to create a personal account.
The Customer must provide complete, up-to-date, and honest information, and EgoFilm cannot be held liable in this regard. The Customer is informed that some of the requested information is mandatory for the proper execution of the Order they placed, which they expressly acknowledge.
The description of the Products is available to the Customer on the Site, which the Customer accepts and acknowledges.
Once the Order is finalized, it is confirmed by EgoFilm by sending an email to the Customer at the address provided during the Order.
The Order is validated once the payment has been fully made and received by EgoFilm.
The Customer will receive an invoice by email summarizing the Products ordered as well as the terms of sale accepted at the time of the Order. This invoice will also be available in the Customer's account if one was created beforehand. It is recommended that the Customer save or print this invoice and keep it.
EgoFilm undertakes to honor validated Orders, within the limits of available stocks.
In the event of the unavailability of one or more Products, the Customer will be informed via information provided on the concerned Product’s page.
Definitive or temporary unavailability shall in no case engage the responsibility of EgoFilm, nor entitle the Customer to any compensation or damages.
EgoFilm may at any time modify the assortment of products offered for sale on the Site, without prejudice to Orders already placed by the Customer.

By confirming the order, the Customer acknowledges that placing an order implies an obligation to pay for the selected products.

ARTICLE 6 – DELIVERY

Important information: deliveries and returns may be disrupted due to causes beyond EgoFilm’s control without EgoFilm being held responsible.
Shipping costs will be specified on the Site, all taxes included for orders delivered in France and within the European Union. For orders to countries outside the European Union, no VAT is applied, but customs fees or other local taxes may be charged by the destination country's authorities. These fees are the Customer’s responsibility and must be paid directly to the competent authorities. EgoFilm cannot be held responsible for any delays or additional costs related to these customs formalities.

Shipping costs will appear on a specific and separate line from the one specifying the price of the Products.
It is expressly specified that the amount of shipping costs may vary depending on the delivery territory of the Products, which the Customer expressly acknowledges and accepts.
Delivery times are indicated on the Site and depend on the delivery method chosen by the Customer. The delivery times indicated on the Site are indicative deadlines corresponding to average processing and delivery times and are calculated in working days. To ensure these deadlines are met, the Customer must ensure they have provided accurate and complete delivery information (such as, notably: street number, building, staircase, access codes, names and/or intercom numbers, etc.).
Delivery times exclude Saturdays, Sundays, and public holidays.
Delivery times are also reiterated in the Order confirmation email sent to the Customer.
Delivery times include the preparation and shipping of the Order, as well as the delivery time of the Products to the delivery address (Customer’s postal address).
In the absence of an indication on the Site of a delivery time for the Products, EgoFilm undertakes to deliver them within a maximum period of thirty (30) days from the email validating the Order sent to the Customer by EgoFilm. If EgoFilm fails to deliver within this maximum period of thirty (30) days, the Customer may cancel the order by written notice to EgoFilm. Upon cancellation, EgoFilm will refund all amounts paid by the Customer within fourteen (14) days of receiving the cancellation notice, in accordance with Articles L216-2 and L216-3 of the French Consumer Code. In this case, the concerned Products are delivered within the deadline indicated on the Site and reiterated at the time of the Order.
However, since EgoFilm uses external providers (postal services) to ship the Products, EgoFilm is entirely dependent on these third-party providers.

Depending on the Customer’s country of delivery, the manufacturing and shipping of the Products may be handled by different fulfillment centers located in Europe or in the United States. Consequently, delivery times, carriers, and packaging formats may vary by destination. EgoFilm remains the sole seller and contractual point of contact for the Customer, regardless of the fulfillment center used.

Therefore, delivery times indicated on the Site may be impacted by the providers without EgoFilm being held responsible for these delivery delays and their consequences.
When delivery is made against signature, the signature serves as proof of receipt of the package.

If you believe your order has not been received, please contact us via the Contact form or at support@egofilm-universe.com within 21 days of the estimated delivery date so that we can open an inquiry with the carrier.

The transfer of risk and responsibility related to the Products occurs upon receipt of the Products by the Customer. From this date, the Customer is solely and exclusively responsible for them, as well as for their use and any consequences that may arise. Consequently, the Customer undertakes to verify, at the time of delivery, that the delivered order is complete, compliant, and not damaged.
If not, the Customer agrees to refuse the Order upon delivery and to sign any supporting documents. Any Order received and signed by the Customer will be considered complete, compliant, and in perfect condition at the time of delivery.

The Customer is solely responsible for ensuring that the ordered Products are authorized for import into their destination country. EgoFilm cannot be held responsible in case of blocking, import refusal, or confiscation of the Products by local authorities.
In the event of a ban on the entry of Products into the Customer’s country, no refund or compensation can be demanded from EgoFilm.

Delivery restrictions
EgoFilm does not offer delivery to certain territories subject to international economic sanctions or import restrictions.
In particular, orders from Afghanistan, Belarus, North Korea, Iran, Russia, Syria, and any other country subject to applicable sanctions are automatically blocked on our platform.

EgoFilm currently fulfills orders worldwide, except for regions under international sanctions. However, due to logistical constraints, orders delivered within the United States are fulfilled through a US-based production center, while orders to other destinations are fulfilled through a European partner. These differences do not affect the price paid by the Customer, except for potential variations in delivery times and local customs procedures.

ARTICLE 7 – PAYMENT

7.1. Accepted Payment Methods

The Customer can pay for their purchases on the egofilm-universe.com website using the following payment methods:

• Bank cards from the Visa, Mastercard, American Express, Discover, JCB, Diners Club, and UnionPay networks.
  
  
• Digital wallets: Apple Pay, Google Pay, and Shop Pay (available via Shopify Payments).
  
  
• PayPal, for users with an account or those wishing to pay by credit card via this platform.
  
  

7.2. Purchase of Gift Cards on the Site

E-gift cards are available for sale on the website. These cards are valid only on the egofilm-universe.com website for a period of one year from the activation date.
The e-gift cards can be used on the website by entering the gift card code provided in the confirmation email sent after purchasing the gift card on the website.
It is possible to enter one or more codes cumulatively on the same order.
If the total amount of the order exceeds the amount of the gift card(s), the balance will need to be paid using other payment methods offered on the site (bank card). If the total amount of the order is less than the amount of the gift card(s), the Customer will not have to make any additional payment and will receive by email a new code corresponding to the remaining balance on the gift card, usable on their next purchase on the website.
The validity date of this new code is identical to that of the original code.

7.3. Refund of an Order Paid with a Gift Card

In case of return of an order paid partially or fully with a gift card, no cash refund or refund via another means of payment will be made.
If the return is deemed valid, according to the conditions mentioned in the returns section of these General Terms and Conditions of Sale, a new gift card will be issued for an amount corresponding to the returned items.
The new gift card will have a validity period of one (1) month from its date of issue, regardless of the remaining validity of the initial gift card.

ARTICLE 8 – WITHDRAWAL

In accordance with the provisions of Article L.121-18 of the Consumer Code, you have a withdrawal period of 14 days from the receipt of your products to exercise your right of withdrawal without having to justify reasons or pay penalties.
The products must be returned in their original packaging, carefully opened and in a condition fit for resale. In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal. Return costs remain your responsibility.
In the event of exercising the right of withdrawal, EgoFilm will refund the amounts paid, within 14 days following the notification of your request and via the same means of payment used when placing the order.
EgoFilm grants the same withdrawal period of fourteen (14) days to all its Customers, including those located outside the European Union.

Returns & Exchanges – Region-Specific Policy 

Important: Customers must contact EgoFilm Support first and wait for return instructions.
Do not ship any item back without written authorization (RMA), or the return may be refused or not processed.

A) Orders delivered outside the United States (EU & Rest of World)

 

1) Defective / Non-conforming items (wrong product/size/design, printing defect, damaged item)

• -Notify EgoFilm within 48 hours of delivery at support@egofilm-universe.com and include:
  - Order number • Detailed description of the issue • Photos showing the defect/error.
• -Once validated by EgoFilm, you will receive return instructions (if a return is required).
• -EgoFilm will reprint or refund at no additional cost to the Customer.
• -Return address (when applicable):
  EgoFilm – Returns, 96 Rue Paradis, 13006 Marseille, France.

2) Address errors / Undeliverable parcels

• If a parcel is returned due to an incorrect/incomplete address or a failed delivery, it can be reshipped once the Customer provides an updated address and pays the new shipping fees.

3) Change of mind / Wrong size / Personal dissatisfaction

• These returns are not automatically accepted. EgoFilm may, as a goodwill gesture, offer an exchange or store credit on a case-by-case basis.

 

1) Defective / Non-conforming items (misprint, damage, wrong item)

Notify EgoFilm within 30 days of delivery at support@egofilm-universe.com with:

• Order number • Description • Photos of the defect/error.
• EgoFilm will handle the claim with its US production partner and will reprint or refund at no additional cost to the Customer.
• In most cases, no physical return is required for defects; if needed, EgoFilm will provide the specific US return address.
• Do not send products to the French address above for US orders unless EgoFilm expressly instructs you to do so.

2) Address errors / Undeliverable parcels

• Parcels returned due to an address issue may be reshipped once a corrected address is provided and new shipping fees are paid.

3) Change of mind / Wrong size / Personal dissatisfaction

• Not automatically accepted. EgoFilm may, as a goodwill gesture, offer an exchange or store credit in certain situations.

ARTICLE 9 – PERSONAL DATA

9.1.

Personal data is collected by EgoFilm when an order is placed or when a personal account is created by the Customer.
Creating a personal account is not mandatory to place an Order on the Site; the Customer has the option to place an Order as a "guest."
Moreover, personal data is collected through cookies. This type of collection is addressed in Article 9.2 below.
When placing an Order, certain personal data must be provided by the Customer and collected by EgoFilm. This includes the Customer’s last name, first name, email address, postal address, and phone number.
The same personal data is required when creating a personal account.
This personal data is subject to automated processing for managing the Order and EgoFilm's customer database, as well as for commercial prospecting and statistical purposes.
They may be transmitted to EgoFilm’s business partners who contribute to the delivery of Products and the execution of payments, solely for this purpose, which the Customer expressly acknowledges and accepts.
Furthermore, within the framework of online payment services used by EgoFilm, these services collect certain personal data belonging to Customers on behalf of EgoFilm.
The said data is kept for the time necessary for the purposes for which it is collected and processed, namely for the fulfillment of the Customer’s Order, unless:

• a longer retention period is permitted or imposed by a legal or regulatory provision;
  
  
• the Customer exercises, under the conditions set out below, one of the rights recognized by legislation.
  
  

Moreover, when the Customer has created a personal account, the personal data communicated for this purpose is retained until the account is deleted, which can be requested from EgoFilm under the conditions described below.
Subject to the Customer’s express acceptance through checkboxes, the Customer’s email address may also be used by EgoFilm for registration and sending of a newsletter and/or promotional offers.
If the Customer no longer wishes to receive newsletters and/or promotional offers, they can change their choice by contacting EgoFilm as indicated below or by using the unsubscribe links provided in the messages.

Access to personal data is strictly limited to EgoFilm employees authorized to process it by virtue of their functions. The information collected may be communicated to third parties linked to EgoFilm by contract for the execution of subcontracted tasks necessary for the management of the Order, without requiring the Customer's authorization.
It is specified that, within the framework of performing their services, third parties have only limited access to the data and are contractually obligated to use it in compliance with the applicable legislation on personal data protection.
Apart from the cases set out above, EgoFilm undertakes not to sell, rent, transfer, or give access to third parties to the data without the Customer’s prior consent unless compelled by a legitimate reason (legal obligation, fight against fraud or abuse, exercise of defense rights, etc.).

In accordance with applicable legal and regulatory provisions, particularly law no. 78-17 of January 6, 1978, as amended, relating to information technology, files, and freedoms, and European regulation no. 2016/679/EU of April 27, 2016, the User has a right of access, rectification, portability, and deletion of their data or a right to limit the processing. They may also, for legitimate reasons, oppose the processing of their data.
They may thus require that inaccurate, incomplete, ambiguous, or outdated personal data be rectified, supplemented, clarified, updated, or deleted.
The User’s personal data is also deleted when the User expressly withdraws their consent regarding the collection and processing of their data, subject to EgoFilm’s legal obligations.
The User may also, under the right to data portability, recover the personal data concerning them for personal use or request that it be transferred to a third party if technically feasible.
Each User may also object, for legitimate reasons, to the processing of their data and request the limitation of the processing of their data.

To exercise these rights, the User must send a request by email to support@egofilm-universe.com indicating their first and last names.
EgoFilm may ask the User to prove their identity by attaching any necessary document, such as a copy of their ID card or passport.

EgoFilm will implement the means at its disposal to process requests concerning Users' personal data.
In case of a security breach on the Site or loss of personal data concerning Users, EgoFilm will inform them by email under the applicable legal conditions.
It will take all necessary measures, within the limits of its human, material, and financial resources, to remedy the breach and ensure the security of the data.

Users also have the right to file a complaint, which they can exercise with the national supervisory authority, namely the CNIL.

9.2.

EgoFilm may implement cookies on the Site.
This is an automatic tracking process that records information related to navigation on the Site and stores information entered during visits to the Site to facilitate its use.
Cookies installed by EgoFilm are deleted from the Customer’s computer device after 13 months.
The User can oppose their installation and/or delete them by following the procedure indicated in their browser.
In this regard, EgoFilm collects the express consent of Users regarding the use of these cookies and uses them in accordance with legal provisions, including the General Data Protection Regulation.
EgoFilm uses these cookies solely to compile connection statistics as well as browsing histories of Users.

ARTICLE 11 – PROMOTIONAL CODES

Promotional codes apply only to non-discounted base prices.
Promotional codes cannot be combined with each other or with gift vouchers.
Promotional codes can be used once per Customer account unless otherwise instructed by EgoFilm.
These codes are not reusable after a returned order.

ARTICLE 12 – INTELLECTUAL PROPERTY

Without this list being exhaustive, the EgoFilm brand and its derivatives and variations, the logos, the graphic charter, the layout, the information, the presentation, and the content of the Site are the exclusive property of EgoFilm.
The systems, software, structures, infrastructures, databases, and contents of any kind (texts, images, visuals, music, logos, brands, databases, etc.) related to the Site are also protected by all intellectual property rights or database producer rights in force, of which EgoFilm is the sole holder or rights owner.
Any disassembly, decompilation, decryption, extraction, reuse, copying, and more generally, any act of reproduction, representation, dissemination, and use of any of these elements, in whole or in part, without the prior written authorization of EgoFilm, is strictly prohibited and may result in legal action.

Any reproduction or representation, in whole or in part, of the Site or of the elements composing it, such as the brands, logos, graphic charter, layout, information, presentation, and content of the Site, without this list being exhaustive, is prohibited.
Browsing the Site does not entail any transfer of intellectual property rights to the User’s benefit.
EgoFilm grants the User only a right of access and consultation of the Site, under the conditions and modalities provided in these Terms and Conditions of Sale.

ARTICLE 13 – LIMITATION OF LIABILITY

13.1

EgoFilm declines all responsibility for any damages of any kind, resulting in particular from the use of the Site or the ordering of Products, notably any damage to the Customer’s reputation and image, or any loss of data that may occur due to the use of the Site.
If EgoFilm’s liability were to be established and retained due to damage suffered by the Customer and exclusively attributable to EgoFilm, it would be limited to the amount of the Order paid by the Customer to EgoFilm.

13.2

The User acknowledges that their use of the Site is at their own risk.
The Site is provided "as is" and is accessible without any guarantee of availability and regularity.
EgoFilm will do its best efforts to make the Site accessible 24 hours a day, seven days a week, except in cases of force majeure or an event beyond the control of EgoFilm and subject to maintenance periods, possible breakdowns, technical hazards related to the nature of the network, or acts of malice or any attack on EgoFilm’s hardware or software.

13.3

EgoFilm cannot be held liable for any interruption of all or part of the Site, regardless of the cause, duration, or frequency of such interruption.

13.4

The Site has the necessary technology to date for its access and use; however, the existence of potential viruses or other harmful elements, introduced by any means or by any third party, that may produce alterations in the User’s computer systems cannot be excluded.
EgoFilm offers no explicit or implicit warranty regarding the operation of the Site, including any technical issues that may arise.
EgoFilm reserves the right to modify, at its discretion and unilaterally, at any time and without prior notice, the configuration of the Site, the services or content offered, as well as the right to eliminate, limit, suspend, or prohibit access to it, temporarily or permanently.

13.5

EgoFilm’s liability under these General Terms and Conditions of Sale cannot be engaged if the non-performance of its obligations is attributable to a third party even if foreseeable, to the Customer’s fault, or to the occurrence of a force majeure event as defined by French courts and Article 1218 of the Civil Code, or to any other event reasonably beyond EgoFilm’s exclusive control.
It is agreed that if EgoFilm’s liability is engaged, whatever the basis and/or nature of the action, only direct and foreseeable damages may give rise to compensation.
Thus, indirect, consequential, and/or incidental damages, such as commercial disturbances, loss of clientele, etc., will not give rise to compensation for the User.
In any event, EgoFilm’s liability, in the event of damage caused to the Customer, for any reason whatsoever, will be expressly limited and may not exceed the total amount excluding taxes of the Customer’s Order placed under these Terms. EgoFilm shall not be held liable for manufacturing or shipping delays attributable to its external production or logistics partners, nor for delivery delays related to international carriers, provided that EgoFilm has duly transmitted the order in accordance with its contractual obligations.

13.6

The Customer agrees to use the Products in strict accordance with the instructions for use provided by EgoFilm.
Therefore, EgoFilm cannot be held liable in the event of non-compliant use of the Products by the Customer or a third party.

ARTICLE 14 – LEGAL WARRANTY

In accordance with the provisions of the Consumer Code, the Products sold on the Site benefit from legal warranties, namely the warranty of conformity (Articles L.217-4 et seq. of the Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the Civil Code), allowing Customers to return defective and non-conforming Products free of charge.

14.1. Warranty Against Hidden Defects

In accordance with Articles 1641 and following of the Civil Code, EgoFilm is liable for hidden defects in the Products sold that render them unfit or significantly impair the use for which they are intended.
The Customer may bring an action based on a hidden defect within two years from the discovery of the defect.
Under the legal warranty against hidden defects, EgoFilm, according to the Customer’s choice, undertakes, after assessment of the defect either:

• to reimburse the full price of the concerned Product;
  
  
• to reimburse part of the price if the Customer decides to keep the Product.
  
  

14.2. Legal Warranty of Conformity

In accordance with Articles L.217-4 et seq. of the Consumer Code, EgoFilm is required to deliver Products that conform to the Customer’s Order, namely:

• Products corresponding to the description given by EgoFilm;
  
  
• Products with the qualities that the Customer can legitimately expect in view of EgoFilm's public statements.
  
  

The Customer may bring an action based on a lack of conformity within two years from the delivery of the Product, it being understood that any lack of conformity appearing within two years of delivery is presumed to have existed at the time of delivery.
Under the legal warranty of conformity, EgoFilm, according to the Customer’s choice, undertakes, after assessment of the defect, either:

• to reimburse the price of the concerned Product;
  
  
• to exchange the Product for a Product conforming to the Order, if possible.

ARTICLE 15 – COMPLAINT – INFORMATION

ARTICLE 16 – MISCELLANEOUS PROVISIONS

16.1. Partial Invalidity

If one or more provisions of these General Terms and Conditions of Sale are held to be invalid or declared as such under a law, regulation, or following a final decision by a competent court, the other provisions will retain their full force and scope.

16.2. No Waiver

The fact that one of the Parties does not claim a breach by the other Party of any of the obligations referred to in these General Terms and Conditions of Sale shall not be interpreted in the future as a waiver of the obligation in question.

16.3. Mediation

In the event of a dispute relating to an Order, the Customer must first contact EgoFilm to seek an amicable solution by email at support@egofilm-universe.com
Referral to the mediator can only occur after the Customer has made prior written efforts with EgoFilm.
Furthermore, in accordance with Article 14 of Regulation (EU) No. 524/2013, the European Commission has set up an Online Dispute Resolution platform, facilitating the independent out-of-court settlement of online disputes between consumers and professionals within the European Union. This platform is accessible at the following link: https://webgate.ec.europa.eu/odr/.

16.4. Applicable Law and Jurisdiction

These General Terms and Conditions of Sale as well as the contractual relations between EgoFilm and the Customer are governed by French law, excluding any other legislation.
In the event of translation of these Terms and Conditions into one or more foreign languages, only the French version shall prevail in case of dispute.
Any dispute relating to the interpretation, validity, execution, or termination of these General Terms and Conditions of Sale, as well as to any sale concluded between EgoFilm and the Customer, will be subject to the exclusive jurisdiction of the courts of Marseille (France), even in the case of multiple defendants or third-party claims.
The Customer is informed that they may, in any case, resort to a conventional mediation procedure or any alternative dispute resolution method (such as conciliation) before any legal action.

ARTICLE 17 – AMENDMENTS TO THE TERMS AND CONDITIONS

EgoFilm reserves the right to amend these General Terms and Conditions of Sale at any time.
The applicable Terms and Conditions are those present on the Site, the latest modification of which took place on 01/20/2025.
